Proposed Ordinance No. 141-AA - Micro-Hospital Use in Commercial Zone

The title of the Ordinance is “AN ORDINANCE AMENDING THE UPPER SAUCON TOWNSHIP ZONING ORDINANCE OF 2009 TO ADD NEW DEFINITIONS RELATING TO TYPES OF MEDICAL TREATMENT FACILITIES; ADDING A SPECIALTY / MICRO-HOSPITAL USE IN THE COMMERCIAL (C) ZONE AND REGULATIONS APPLICABLE THERETO; ADDING OR MODIFYING ADDITIONAL REGULATIONS RELATING TO “MEDICAL OFFICE,” “MEDICAL FACILITY,” “URGENT CARE FACILITY,” AND “MEDICAL / DENTAL / OPTICAL LAB;” MAKING REVISIONS TO THE LIST OF PERMITTED USES IN THE COMMERCIAL (C), INDUSTRIAL (I), AND ENTERPRISE (E) ZONING DISTRICTS AND ARTICLE 4, SPECIFIC CRITERIA CONSISTENT WITH THE DEFINITIONAL CHANGES AND SPECIALTY / MICRO HOSPITAL USE; AND REVISING PARKING REQUIREMENTS FOR NEW AND REVISED MEDICAL-RELATED USES AS SET FORTH IN SECTION 314.V.”

The Ordinance will become effective 5 days after enactment. All other ordinances or parts thereof in conflict are repealed to the extent of such conflict. The Ordinance contains Legislative Findings explaining its history, purpose, intent and rationale and a savings clause. Generally, it amends the Township’s Zoning Ordinance to address certain medical-related facilities and uses.
The text amendment is found at Section 2 of the Ordinance and provides for a series of new or modified medical-related definitions. One, new definition is “Specialty / Micro-hospital (“SMH”). An SMH is a permitted use in the Commercial (C) zoning district which provides inpatient and outpatient services. It can provide up to 10 beds and 10 emergency treatment bays. Additional regulations address lot size, signage, buffers, and other site and operational requirements for an SMH as well as uses accessory to an SMH and requirements for the same. Section 2 also includes amendments which are technical in nature and intended to conform the existing Commercial, Industrial, and Enterprise Zoning regulations to the new and modified medical definitions and the SMH use. Others address signage and parking requirements. A revised table relating to sign requirements is attached which adds new requirements for monument signs.
Copies of Ordinance No. 141-AA may be examined, without charge or obtained upon payment of a fee not greater than the cost thereof, at the Upper Saucon Township municipal building located at 5500 Camp Meeting Road, Center Valley, Pennsylvania, during normal business hours, Monday through Friday, from 8:00 a.m. to 4:30 p.m. In addition, and in accordance with Section 610 of the Municipalities Planning Code, as amended, 53 P.S. § 10610, attested copies of the proposed Ordinance have been filed in the Lehigh County Department of Law (Lehigh County Government Center, 17 S. 7th Street, Allentown, PA) and supplied to The Morning Call newspaper.
